Terms of Use for the website “Live Is Dive”
Welcome to LIVE IS DIVE (liveisdive.com, the “Platform” or the “Site”). LIVE IS DIVE is a free online directory that helps divers find dive centers and liveaboards worldwide by country, destination and specialty, and helps operators be found and contacted directly by divers. These Terms of Use (the “Terms”) are a public offer governing your use of the Site.
If you are a dive center or liveaboard operator with a listing on the Platform, your relationship with us is also governed by our Listing Terms, which describe the free and paid listing plans. Where these general Terms and the Listing Terms conflict on a matter specific to Partner listings, the Listing Terms control.
1. What LIVE IS DIVE is — and what it is not
1.1 LIVE IS DIVE is a directory and discovery service only. We publish information about dive centers and liveaboards (the “Partners”) — much of it built from Partners’ own public sources when a listing is first created — so that divers (“Users” or “Clients”) can find and contact them.
1.2 We are not a booking agent, travel agent, tour operator or payment processor. The Platform does not book dives, courses or liveaboard trips on your behalf, and does not collect, hold or process payment for any Partner’s services. Any enquiry, reservation, price agreement, payment, cancellation or refund is arranged directly between the Client and the Partner, outside the Platform, under whatever terms they agree between themselves.
1.3 We are not a party to, and accept no responsibility for, any transaction, contract or dispute between a Client and a Partner.
1.4 We charge no commission on services booked as a result of a Platform enquiry.
2. Acceptance of these Terms
2.1 By browsing, registering on, or otherwise using the Site, you confirm that you have read and accept these Terms. If you do not agree, please do not use the Site.
2.2 These Terms are an open, public document available at liveisdive.com/documents/terms/. We may update them from time to time; continued use of the Site after a change means you accept the updated Terms. Material changes will be reflected by an updated publication date.
3. Registration and your account
3.1 Browsing and searching the Site does not require registration. Creating or claiming a listing, or contacting a Partner through certain forms, may require a free account.
3.2 When registering, you agree to provide accurate and current information (including a valid email address) and to keep your login credentials confidential. You are responsible for all activity under your account.
3.3 One person or organisation should not maintain more than one account for the same purpose, and accounts may not impersonate another person or entity without authorisation.
3.4 You may close your account at any time by contacting support@liveisdive.com.
4. Using the Site responsibly
4.1 You agree not to: submit false, misleading or unlawful information; scrape, copy or republish Site content at scale without permission; interfere with the Site’s operation or security; use the Site to send spam or unsolicited commercial messages to Partners or Users; or impersonate any person or entity.
4.2 We may moderate, edit or remove content (including listings, reviews and messages) that violates these Terms or applicable law, and may suspend or close an account for breach of these Terms, fraud, or conduct that threatens the Site or its Users, with or without prior notice.
5. Listings, reviews and accuracy of information
5.1 Partner listings may be created by the Platform from a Partner’s own public sources, by the Partner directly, or claimed by a verified Partner. Listing content (descriptions, services, prices, availability, photos) is the responsibility of the Partner who owns or maintains it, and we do not guarantee it is current or accurate at the time you view it — always confirm details directly with the Partner before making plans.
5.2 Paid listing plans, pricing and billing terms are described exclusively in the Listing Terms (liveisdive.com/terms/listing/) and are not restated here; that document, not these general Terms, governs any Premium or Pro plan a Partner purchases.
5.3 If you submit a review or other content, you confirm it reflects your genuine experience, and you are solely responsible for it. We do not endorse, and are not liable for, User- or Partner-submitted content.
5.4 A Partner may request correction of factual errors in their own listing; genuine, non-abusive reviews will not be removed simply because a Partner objects to them.
6. Diving is a safety-sensitive activity
6.1 Scuba diving and related activities carry inherent risk. LIVE IS DIVE does not verify, and makes no representation about, any Partner’s certifications, licenses, insurance, equipment condition or safety record. You are responsible for satisfying yourself — directly with the Partner and, where relevant, with the certifying agency (PADI, SSI or other) — that a Partner and its instructors are properly qualified and insured before booking or diving with them.
6.2 You are responsible for your own fitness to dive, for disclosing relevant medical information to the Partner, and for holding appropriate travel and diving insurance.
7. Intellectual property
7.1 The Site’s design, software and LIVE IS DIVE’s own text and branding are owned by LIVE IS DIVE or its licensors and may not be copied or reused without permission, except as needed for normal browsing.
7.2 Content that a Partner or User submits (photos, descriptions, reviews) remains that party’s property; by submitting it you grant LIVE IS DIVE a non-exclusive, royalty-free licence to display it on the Site for the purpose of operating the directory. You confirm you have the right to submit that content.
7.3 If you believe content on the Site infringes your rights, contact support@liveisdive.com with details and we will review it.
8. Disclaimer and limitation of liability
8.1 The Site and its content are provided “as is”. To the extent permitted by applicable law, LIVE IS DIVE disclaims warranties of any kind regarding the Site’s availability, accuracy or fitness for a particular purpose.
8.2 To the extent permitted by applicable law, LIVE IS DIVE is not liable for any loss arising from: (a) a Partner’s services, conduct, safety practices or failure to perform; (b) inaccurate or outdated listing information; (c) any transaction, payment, cancellation or dispute between a Client and a Partner; or (d) interruptions or errors in the Site’s operation.
8.3 Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Data and privacy
9.1 We process personal data as described in our Privacy Policy and Cookie Statement. When you submit an enquiry to a Partner through the Site, we share the details you provide (such as your name, email, phone and trip dates) with that Partner so they can respond to you directly.
10. Changes, suspension, and term
10.1 These Terms apply from the moment you first use the Site and for as long as you continue to use it. We may update the Site’s features or these Terms at any time; if you keep using the Site afterward, the updated version applies to you.
10.2 We may suspend or discontinue all or part of the Site, temporarily or permanently, with or without notice.
10.3 If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
11. Governing law
11.1 [!] Working draft — pending legal review. LIVE IS DIVE does not yet operate through a registered legal entity. Once the operating entity is incorporated, these Terms will be governed by the laws of that entity’s jurisdiction of incorporation, and this section will be updated accordingly.
