1.1 These Listing Terms (the "Terms") are a public offer by LIVE IS DIVE (the "Platform") to any dive center or liveaboard operator (the "Partner").
1.2 The Partner accepts these Terms electronically when registering or claiming a listing. Purchasing a Premium plan constitutes acceptance of the Premium clauses.
2.1 The Platform provides a listing and discovery service only. The Platform is not a party to any transaction between the Partner and a Client and does not collect or hold Client payments.
2.2 The Partner contracts directly with the Client, provides the service, collects payment from the Client, and is solely responsible for the service, its quality and safety.
3.1 The basic listing is free and includes catalog and search presence and the core fields set out by the Platform.
3.2 The Platform may set reasonable limits for basic listings.
4.1 Paid plans provide added visibility and features as described on the Platform. Plans: Premium (15 USD per month) and Pro (30 USD per month).
4.2 Trial: 30 days free (subject to change).
4.3 Payment by bank transfer invoice, card, PayPal or crypto, as offered on the Platform. Fees are non-refundable except as required by applicable law or stated at purchase.
4.4 Renewal: as stated at purchase. The Partner may cancel before renewal.
5.1 Provide accurate listing information, prices and availability.
5.2 Respond to Client enquiries received through the Platform.
5.3 Hold all licenses, certifications and insurance required in its jurisdiction and meet recognized safety standards.
6.1 Publish the listing and forward Client enquiries.
6.2 Provide the Premium features for a paid plan.
7.1 The Platform charges no commission on Partner services and makes no payouts to the Partner under these Terms.
8.1 The Platform is a listing intermediary and is not liable for the Partner services or for any Partner-Client transaction, to the extent permitted by applicable law.
9.1 Each party is responsible for its own taxes.
10.1 Effective from acceptance until terminated.
10.2 The Platform may suspend or remove a listing for breach, fraud or repeated complaints.
11.1 Processing under applicable data protection law and the Platform Privacy Policy.
12.1 The Platform may update these Terms and will notify Partners.
13.1 Governed by the laws of Kazakhstan. Disputes resolved in the competent forum in Kazakhstan (to be confirmed).
